During the course of this last month we did a blog on Accident damaged vehicles being Defective Motor Vehicles and in that blog we also covered the consumers rights, in terms of the Consumer Protection Act No 68 of 2008(CPA), to claim a repair, a replacement or a refund of the purchase price from the dealer and/or service provider in the event that the consumer had bought a defective/accident damaged vehicle.

We continue to get daily inquiries about this problem.

A purchaser also has similar rights in terms of the common law, in the possible event that the CPA is not applicable in the circumstances of any particular case. This can occur for example when the 6-month statutory period since the date of sale has already expired.

The Consumer Protection Act No 68 of 2008 (CPA).

There have been enormous innovations, improvements and new legislation in this field of the law over the last decade.

One of the most important pieces of legislation for the protection of consumers has been the promulgation of The Consumer Protection Act.

Prior to the commencement of The Consumer Protection Act, No 68 0f 2008 (CPA) which came into effect at midnight on the 31st March 2011; consumers had very little defence against abuse by service providers and/or abusive business practices; other than their normal common law or contract law rights.

An electronic agreement for the purchase of a house is not currently valid in our law.

Some are straightforward; others really interesting.

At The Legal Advice Office; we received the following query last week

 “I am in the process of purchasing a house in Pretoria, but live in Bloemfontein.

I recently bought my motor vehicle by merely signing certain online documentation electronically, and it was so quick and easy to complete. I asked the estate agent in Pretoria who is acting for the seller if I can use the same technology to purchase the house, but she said that the contract won’t be valid if I sign it electronically. Is this true? Please, could you advise me?”
